Terms of Service

1. Agreement

These Terms of Service ("Terms") form a binding agreement between you and WhereIsMyCat ("we", "us") covering your use of the WhereIsMyCat mobile app, website, and all related services (together, the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy.

2. What the Service does

The Service lets you report a missing cat, post sightings of cats you have seen on the street, view reports near you, and send push alerts to neighbours in the affected area. It is a coordination tool. We do not guarantee that a cat will be found and we do not act as a rescue or veterinary service.

3. Eligibility and accounts

• You must be at least 13 years old to use the Service.
• You sign in with Sign in with Apple or Google. You are responsible for keeping that provider account secure. You must not impersonate another person.
• You may delete your account at any time from the in-app Settings screen. Deletion is permanent and removes your reports, sightings, photos, and purchase history.

4. Acceptable use

You agree not to:

• Post false or misleading reports, or misuse the Service to harass, defraud, or deceive other users.
• Upload content you do not have the right to share, or content that is illegal, hateful, sexual, or otherwise inappropriate. Photos must contain a cat.
• Post personal information about other people without their consent.
• Attempt to interfere with the Service, reverse-engineer it, scrape it at scale, or probe its security without our written permission.

We may remove content and suspend or terminate accounts that break these rules, with or without notice.

5. Your content

You keep all rights in the reports, sightings, and photos you upload ("Your Content"). By uploading, you grant us a worldwide, royalty-free, non-exclusive licence to host, display, distribute, and process Your Content solely to operate and improve the Service — for example, showing your report to other users near you, and running the automatic cat-photo check. You can revoke this licence by deleting the content or your account.

You are solely responsible for Your Content. Do not upload information you would not be comfortable showing publicly.

6. Urgent Boost (paid feature)

• An Urgent Boost highlights your missing-cat report and sends a push alert to users within roughly 5 kilometres. It lasts 7 days.
• Prices in the app are shown by Apple (mobile) or Stripe (web) in your local currency. Reference prices: €4.99 for the first activation, €2 for renewals after the boost has expired. Prices may change; the price displayed at checkout is the price you pay.
• Mobile purchases are handled by Apple through the App Store and are governed by the Apple Media Services Terms. Refund requests for App Store purchases must be made to Apple.
• Web purchases are handled by Stripe. Because an Urgent Boost is a digital service that begins immediately on purchase, you agree that we may begin performance right away and, to the extent permitted by law, that you lose any right of withdrawal once the boost is active.
• Urgent Boosts are non-transferable and cannot be moved between reports or accounts.

7. Third-party services

The Service relies on Supabase, Apple, Google, RevenueCat, Stripe, PostHog, and Anthropic. Your use of the Service is also subject to their applicable terms. We are not responsible for outages, changes, or content originating from those third parties.

8. Disclaimer

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that the Service will locate any missing cat or that alerts will be received by any particular user.

9. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits, arising from your use of the Service. Our total liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the claim, or (b) EUR 25.

10. Indemnity

You agree to indemnify and hold us harmless from any claim, damage, or expense (including reasonable legal fees) arising from Your Content, your use of the Service, or your breach of these Terms.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you break these Terms, if we are required to by law, or if we discontinue the Service. Sections that by their nature should survive (content licence, disclaimers, liability, governing law) will survive termination.

12. Changes

We may update these Terms from time to time. Material changes will be announced in the app or by email where appropriate. Continued use after the effective date of an update means you accept the new Terms.

13. Governing law

Unless required otherwise by mandatory local consumer-protection law in your country of residence, these Terms are governed by the laws of Portugal, and any dispute will be resolved by the competent courts of Lisbon, Portugal.

14. Apple end-user licence (EULA)

The mobile app is licensed, not sold, to you. If you download the app from the Apple App Store, the following also applies:

• This licence is granted to you by us; Apple has no obligations relating to the app or its content.
• The licence is limited to a non-transferable use of the app on any Apple device you own or control, subject to the Usage Rules in the Apple Media Services Terms.
• Apple is not responsible for maintenance or support of the app. Contact us at support@whereismycat.org for support requests.
• Apple is not responsible for any product warranties, product liability claims, or third-party claims that the app or your possession and use of it infringes that party's intellectual property rights.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.
